Defining m.im. rules for concluding sales contracts through the Store, containing the most important information about the Seller, the Store and the rights of the Consumer.

Annex 2: Privacy Policy.

§ 1 DEFINITIONS

E-mail address - the Buyer's current and used e-mail account provided in the Account registration process, necessary for its management. All Al-kor's declarations of will sent to the Buyer's e-mail address shall be deemed delivered upon their sending. The Buyer bears the sole risk of loss of functionality or failure of the e-mail address provided by him.

Personal data - any information related to an identified or identifiable natural person processed by Al-kor for the proper provision of the Services specified in these Regulations, as well as for statistical purposes related to the operation of the Website and the possible consideration of complaints.

Working days - days from Monday to Friday, except public holidays.

Password - a unique sequence of 8 to 20 characters, known only to the Buyer, with at least one letter and one number, enabling the Buyer to authenticate himself on the Website. The allowed special characters are! @ # $ ^ * () _ + - = `[\] {} |;:,. \ /? ] * $,

 

Consumer - a natural person who performs a legal transaction with the Entrepreneur not directly related to its business or professional activity.

Account - the user's administration panel on the Website assigned to the Buyer, which enables the introduction and changes to the Buyer's data (in accordance with the scope collected during the registration process described in the Regulations). Through the Buyer's Account, it is possible to purchase Products by placing Orders. Blocking the Buyer's Account is tantamount to terminating the Agreement for the Provision of Services by Electronic Means. Suspending the Buyer's Account is tantamount to blocking all Account functionalities in a way that prevents the Buyer from further use of it.

Buyer or Customer - an adult natural person with full legal capacity, a legal person or an organizational unit without legal personality, registered on the Website, which as a result of registration received a Login and Password.

Product - items presented by the Seller in the Store, for which the Buyer may place an Order;

Entrepreneur - an entrepreneur is a natural person, a legal person or an organizational unit that is not a legal person, to which a separate act grants legal capacity, carrying out economic activity. Entrepreneurs are also partners of a civil partnership in the scope of their business activity.

Regulations - these Website Regulations.

 

GDPR - Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC

 

Website, Store - an IT system managed by Al-kor, intended for making purchases, at https://solidpaint.pl/.

The seller, Al-kor - Wojciech Borowski, running a business under the name Al-kor Wojciech Borowski, with its registered office at ul. Olimpijska 2, 81-538 Gdynia, NIP 7411186582, REGON 280465940.

Agreement for the Provision of Services by Electronic Means - the obligation relationship concluded between Al-kor and the Buyer at the moment of activating the Buyer's Account, with the content specified in these Regulations.

Services - services indicated in the Regulations provided by Al-kor to the Buyer through the Website without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the Buyer, sent and received using electronic processing devices, including digital compression, and data storage, which is entirely broadcast, received or transmitted via a telecommunications network within the meaning of the Act of 16 July 2004 - Telecommunications Law (Journal of Laws No. 171, item 1800, as amended).

Act on Providing Services by Electronic Means - the Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended).

Order - a binding declaration of will of the Buyer, leading to the conclusion of a sales contract with the Store on the terms specified in the content of these Regulations, Product description and warranty card (if granted).

 

§ 2 PRELIMINARY INFORMATION AND CONTACT DETAILS

  1. Via the Store, the Seller sells high-quality anti-corrosion paints from the manufacturer of paints and protections for the land industry and 
  2. ship in accordance with the Act on Providing Services by Electronic Means, as well as Services consisting in registration and maintenance of an Account on the Website.

    Products sold through the Store are brand new, free from physical and legal defects, have been legally placed on the Polish market, and have all approvals required by Polish law.
  3. The prices of all Products published on the Store's website are given in Polish zlotys and are valid while stocks last.
  4. Information about the price of the Products, features and essential properties of the Products are available on the Store's website and are placed next to the presented Product, while the colors of the product photos displayed on the monitor screen may slightly differ from the actual ones due to limitations resulting from monitor settings.
  5. The Seller reserves the right to make changes to prices and information about Products, to post new information, to withdraw individual Products presented on the Store's website, and to carry out and cancel all kinds of promotional campaigns and sales. The right referred to in the previous sentence does not affect Orders placed before the effective date of the price change, promotional campaign conditions or sales.
  6. In the case of promotional sales and sales for which a limited number of Products is intended, the Orders will be processed in the order in which Orders are received for these Products, until the stocks covered by these forms of sale are exhausted.

§ 3 FURTHER INFORMATION

1. The sale and service of the Account is provided on the terms set out in these Regulations, which, inter alia, defines:

a. conditions for the sale of Products,

b. types and scope of Services,

c. conditions for the provision of Services, including:

d. technical requirements necessary to cooperate with the Website's ICT system,

e. prohibition of the Participant from providing illegal content;

f. conditions for concluding and terminating Contracts for Provision of Services by Electronic Means;

g. conditions for concluding and terminating sales contracts,

h. complaint procedure.

2. The operation of the Website is carried out in accordance with the Regulations and generally applicable provisions.

3. By submitting an Order and / or creating an Account on the Website, you accept the provisions of these Regulations unconditionally.

4. At the time of placing the Order, the Buyer concludes with the Seller an Agreement for the Provision of Services by Electronic Means, which is concluded for a definite period until the Product being the subject of the Order is delivered to the Buyer or until the procedure related to the Buyer's right to submit a declaration of withdrawal from the contract is completed.

5. Only a properly authorized representative may act (use the Account) on behalf of the Buyer who is not a natural person. Authorization to act on behalf of someone else may be based on the act (statutory representation) or on the representation of the person represented (power of attorney, proxy).

6. It is not allowed to use the Website for the purposes that violate generally applicable law or to the detriment of the Store or third parties.

7. The use of the Website requires the Buyer to meet the technical requirements necessary to cooperate with the ICT system used by the Seller. For the proper functioning of the Website on the Buyer's device, the following is required:

1.     a.  Active e-mail address,

        b. A device with Internet access,

        c. A web browser that supports JavaScript and cookies.

8. Information on the function and purpose of the software or data that is not a component of the content of the Service (Website), possibly entered by the Seller into the ICT system used by the Buyer, including information on the use of "cookies" is indicated in the Privacy Policy constituting Annex 2 to the Regulations and available at: http://www.al-kor.eu/rodo.

9. The website protects the Buyers' personal data in the manner indicated in the information clause on the processing of personal data (Privacy Policy constituting Annex 2 to the Regulations and available at: http://www.al-kor.eu/rodo), which is an integral part of these Regulations .

10. The Seller has the right to amend these Regulations, in particular in the case of:

1.       a. changing the terms of the sale,

          b. the need to adapt the Store to the legal provisions applicable to the Store's operations,

          c. improving the security of the Service provided,

          d. changes in the functionality of the Account requiring modification of the Regulations.

11. The buyer will be informed about the planned change to the Regulations at least 7 days before the change is implemented via an e-mail sent to the address assigned to the Account E-mail adress.

12. If the Buyer does not accept the planned change, he should inform the Seller about it by sending an appropriate message to the Seller's e-mail address sklep@solidpaint.pl, which will result in the termination of the Agreement for the provision of electronic services in the field of Account maintenance upon entry into force of the planned change or earlier if the Buyer so requests.

13. If the Buyer does not object to the planned amendment to the Regulations until its entry into force, it is assumed that he accepts it.

14. Removal of the Account (including as a result of the lack of acceptance of changes in the Regulations) does not affect the sales contracts concluded on the basis of Orders placed with its use during the operation of the Account.

15. In the event of the disclosure of objective obstacles on the part of the Seller, preventing or significantly hindering the proper maintenance of the Account, the Agreement for the Provision of Services by Electronic Means may be terminated or its performance suspended until the obstacles cease to exist. In any case, it will take effect immediately upon sending the appropriate statement of the Seller to the e-mail address provided by the Customer. Objective obstacles are understood as force majeure or the result of actions of third parties over which the Seller has no influence (e.g. interruptions in access to the public network).

16. The Seller may terminate the Agreement for the Provision of Services by Electronic Means with the Customer (Account Blocking) with immediate effect for reasons attributable to the Customer, with effect at the time of sending such a statement to the e-mail address provided by the Customer, in the event of:

       a. breach of any of the provisions of these Regulations or;

       b. have reasonable doubts as to the credibility or truthfulness of the data provided by the Customer and the lack of explanation within the time limit specified by the Seller,

       c. any actions taken by the Customer that may hinder or disrupt the functioning of the Store,

       d. have reasonable suspicions that the Customer uses the Website contrary to its intended use, in particular without the intention to fulfill the sales contract on the basis of the placed Order.

§ 4 ACCOUNT

1. Creating an Account is completely voluntary and depends on the will of the Buyer.

2. The account gives the Buyer the opportunity to use the following functionalities:

       a. making purchases using the Buyer's previously entered data,

       b. viewing the history of Orders placed by the Buyer in the Store,

       c. checking the status of the Order,

       d. independent editing of the Buyer's data.

3. In order to create an Account, complete the appropriate form on the Store's website, obligatorily providing the following data:

a. E-mail adress,

b. Password.

4. When creating an Account, the Buyer may optionally provide the following data:

a. First name and last name,

b. Address,

c. Phone number.

5. In addition, optionally, the Buyer may declare his willingness to receive an invoice, in which case he provides the following data:

       a. Company name,

       b. NIP (tax identification number),

       c. HQ adress,

       d. Phone number.

6. At the time of the effective creation of the Account, an Agreement for the provision of electronic services is concluded for an indefinite period between the Buyer and the Seller in the field of keeping the Account on the terms specified in the Regulations.

7. The Buyer may at any time delete his Account without incurring any costs. In order to delete the Account, you should send your resignation to the Seller at the following e-mail address: sklep@solidpaint.pl, which will result in immediate deletion of the Account and termination of the Agreement for the provision of electronic services in in the scope of keeping the Account.

§ 5 SHOPPING IN THE STORE

1. The sale of Products is possible both without creating an Account and with an active Account, individually assigned to the Buyer.

2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded on time and in order to perform the Order.

3. In order to place an Order without having an Account, the following data must be provided:

1.     a. First name and last name,

        b. Shipping address,

        c. Phone number,

        d. E-mail.

4. In order to place an Order without having an Account and receive an invoice, the following data must be provided:

a. Company name,

b. NIP (tax identification number),

c. Phone number,

d. HQ adress.

5. The prices of the Products visible in the Store are the total prices for the Product, including VAT (gross prices).

6. The Seller points out that the total price of the Order consists of the price for the Product indicated in the Store and, if applicable, the cost of delivery of the Product.

7. In order to successfully place an Order, the Customer is obliged to make:

        a. acceptance of the Store Regulations along with the Privacy Policy,

        b. selection of ordered Products,

        c. providing the data referred to in sec. 3, 4 above

        d. choose the payment method,

        e. accepting the terms of the Order

8. The submission of an effective Order by the Customer is associated with the obligation to pay.

9. Before placing an Order, the Customer, using our Product search engine, has the opportunity to find the Product that interests him. After you make you 

of the Product, click the "Add to cart" button. The customer may at any time return to the store to search for and add another Product (by clicking the "Continue shopping" button). You can remove a Product from your shopping list at any time by reducing its quantity to 0 or by clicking "X" in the basket summary.

10. After completing the shopping list, click the "Place an order" button. Then provide your data necessary for the execution of the Order, shipping data and select the form of delivery and the form of transaction confirmation (bill or invoice), and then click the "Order with payment obligation" button.

11. The order is placed upon confirmation of its content and acceptance of the Regulations by the Buyer.

12. Confirming the content of the Order and accepting the Regulations is the same as concluding a sales contract between the Buyer and the Seller.

13. The customer immediately after concluding the contract, but no later than the moment the Product is released, receives a confirmation e-mail containing information on the type, quantity and price of the ordered Products, method and date of payment, along with an attachment, which constitutes these Regulations with the attached hereto. him with the withdrawal form. This document confirms the conclusion of the sales contract. By accepting the Regulations, the Customer agrees to receive such confirmation recorded in a different way than on paper, namely in the form of an e-mail confirming the submission of the Order. The customer may consent to withdraw at any time by sending an e-mail to sklep@solidpaint.pl

§ 6 PAYMENTS

1. You can pay for the placed Order, depending on the Buyer's choice:

        a. Via the payment platform:

  • Transfers 24
  • PayPal
  • Payment Shoper (The payment operator is Blue Media s.a.)

    b. Cash on delivery - in cash when the Product is delivered to the Buyer.

2. The Seller informs that in the case of some payment methods, due to their specificity, payment of the Order by this method is possible only immediately after placing the Order.

3. By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his consent at any time by sending an e-mail to the following address: sklep@solidpaint.pl.

§ 7 ORDER COMPLETION

1. The Seller is obliged to deliver the Product without defects.

2. The deadline for completing the Order is each time indicated in the Store for the selected Product.

3. The Seller reserves the right that the Order shall be processed after the payment of the entire sale price for the Products, unless the Customer has chosen the payment method as payment on delivery. The ownership of the Products will be transferred to the Customer only after the payment of the entire sale price for the Products (subject to transfer of ownership). If the Seller finds no payment to the Seller's bank account within 5 working days from the date of placing the Order, the Customer authorizes the Seller to cancel the entire Order, and the Seller does not have to additionally inform the Customer about this fact. Cancellation of the Order does not apply to Products for which the Customer will pay directly to the courier in accordance with § 6 para. 1 lit. b. Regulations.

4. In a situation where, under one Order, the Buyer has purchased Products with a different delivery date, the Order will be processed on the date appropriate for the Product with the longest deadline.

5. The deadline for completing the Order is counted from the date of accepting the Order for execution, which is confirmed by an appropriate e-mail.

6. The order completion date indicated in the Store is indicative and cannot be the basis for submitting complaints or claims against the Seller.

7. Delivery times may be extended each time, about which we will inform the customer immediately. Any delay in delivery is not the basis for withdrawing from the contract or for the Store to be liable for damages.

8. Countries in which the delivery is carried out:

      a. European Union countries, incl

      b. The Republic of Poland.

9. Products purchased in the Store are delivered via courier. The Seller may enable the selection of available courier services in the sales process in the Store.

§ 8 RIGHT TO WITHDRAW FROM THE CONTRACT

1. The Buyer who is a Consumer has the right to withdraw from the contract concluded with the Seller via the Store, subject to § 9 of the Regulations, within 14 days without giving any reason.

2. The deadline to withdraw from the contract will expire after 14 days from the day:

       a. In which the Consumer came into possession of the Product or in which a third party other than the carrier and indicated by the Consumer came into possession of the Product.

       b. On which the Consumer acquires the possession of the last item or on which a third party, other than the carrier and indicated by the Consumer, acquires the possession of the last item in the case of a contract requiring the transfer of ownership of many items that are delivered separately.

3. In order for the Consumer to exercise the right to withdraw from the contract, he must inform the Seller, using the data provided in § 2 of the Regulations, about his decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or information sent by e-mail).

4. The consumer may use the model withdrawal form at the end of the Regulations, but it is not obligatory.

5. In order to meet the deadline to withdraw from the contract, it is enough for the Consumer to send information regarding the exercise of his right to withdraw from the contract before the deadline to withdraw from the contract.

EFFECTS OF WITHDRAWING FROM THE CONTRACT

6. In the event of withdrawal from the concluded contract, the Seller returns to the Consumer all payments received from him, including the costs of delivering the Product (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery method offered by the Seller), immediately, and in any case not later than 14 days from the date on which the Seller was informed about the Consumer's decision to exercise the right to withdraw from the contract.

7. The reimbursement will be made by the Seller using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution, in each case the Consumer will not incur any fees in connection with this return.

8. The Seller may withhold the reimbursement until receipt of the Product or until proof of its return is provided to him, whichever occurs first.

9. The Seller asks you to return the Product to the following address: ul. Olimpijska 2, 81-538 Gdynia, immediately, and in any case not later than 14 days from the date on which the Consumer informed the Seller about the withdrawal from the sales contract. The deadline is met if the Consumer sends the Product back within 14 days.

10. The consumer bears the direct costs of returning the Product.

11. The consumer is only responsible for reducing the value of the Product resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the Product.

12. If the Product was delivered to the Consumer to the place where he lived at the time of the conclusion of the sales contract, the Seller is obliged to collect the Product at his own expense, if due to the nature of the Product it cannot be returned by regular mail.

13. If there is a need to return funds for a transaction made by the customer with a payment card, the Seller will be refunded to the bank account assigned to the Buyer's payment card.

§ 9 EXCEPTIONS FROM THE RIGHT TO WITHDRAW FROM THE CONTRACT

1. The right to withdraw from a distance contract is not entitled to the Consumer in relation to the items indicated in art. 38 of the Act of May 30, 2014 on Consumer Rights, in particular:

       a. In which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specification or serving to satisfy his individual needs.

       b. In which the subject of the service is an item that deteriorates quickly or has a short shelf-life.

       c. In which the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the package has been opened after delivery.

       d. In which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items.

2. The right to withdraw from a distance contract is not available to the Buyer other than the Consumer.

§ 10 COMPLAINTS

1. The Customer should make efforts to assess the condition of the Product and its compliance with the Order at the time of delivery by the courier and in his presence. In the event of any irregularities, a complaint document should be prepared together with the courier - the courier should have a form appropriate for the given forwarder. In the event of damage, the Product / Products should be returned to the courier. The cost of transporting the damaged Product is borne by the Seller.

2. In the event of a Product defect, the Buyer has the option of complaining about the defective Product on the basis of the warranty or guarantee provided for in the Civil Code, provided that the warranty has been granted.

3. Using the warranty, the Buyer may, on the terms and within the time limits specified in the Civil Code:

      a. Submit a price reduction statement,

      b. In the case of a significant defect - submit a statement of withdrawal from the contract,

      c. Demand that the item be replaced with one that is free from defects,

      d. Demand that the defect be removed.

4. When the damage is found after the courier's departure, the Seller asks for a complaint under the warranty to the postal or electronic address indicated in § 2 para. 7 of the Regulations.

5. If it turns out that in order to consider the complaint, it is necessary to deliver the advertised Product to the Seller, the Buyer is obliged to deliver this Product, in the case of a Consumer at the Seller's expense, to the address street: Olimpijska 2, 81-538 Gdynia.

6. If an additional guarantee has been granted for the Product, information about it, as well as about its conditions, is available in the description of the Product in the Store.

7. Complaints regarding the operation of the Store, including the operation of the Account, should be sent to the e-mail address indicated in § 2 para. 7 of the Regulations.

8. Consideration of the complaint by the Seller will take place within 14 days.

EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS

9. In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, inter alia, with:

      a. Mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which you should apply for mediation. As a rule, the procedure is free of charge. The list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.

      b. Assistance of the competent field of permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which an application should be submitted for consideration of the case before the arbitration court. As a rule, the procedure is free of charge. The list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596.

      c. Free assistance of the municipal or poviat Consumer Ombudsman.

      d. ODR internet platform available at: http://ec.europa.eu/consumers/odr/.

§ 11 RESERVATIONS

1. The Buyer is forbidden to provide illegal content.

2. In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the seat of the Seller.

3. Nothing in these regulations excludes or in any way limits the consumer's rights under the law.

4. Downloading or using the materials available on the Website in any way requires the consent of the Seller and may not violate the provisions of the Regulations and generally applicable law, and may not infringe the interests of the Seller. It is forbidden to aggregate and process data and other information available on the Website for the purpose of their further sharing with third parties within other websites and outside the Internet. It is also forbidden to use the Website's markings, including characteristic graphic elements, without the consent of the Seller.

5. All rights in the field of intellectual property or industrial property protection, including copyrights to the materials available on the Website, in particular descriptions, photographs, diagrams or models, are entitled only to their rightful owners. The use of such materials, in particular their recording and reproduction, placing on the market, public distribution, modifying the entirety and individual fragments, combining with other works and introducing to the computer network is allowed only with the written consent of their rightful owners, otherwise null and void.
