Please read this Privacy Policy ("Policy") carefully, in which we present information on the methods of protection of personal data of Partners and Clients cooperating with AL-KOR, as well as on the purposes and methods of data processing by AL-KOR in the course of responding to your inquiries and presenting you with offers, as well as during the performance of concluded contracts and delivery.

This Policy also describes the rules of using the websites www.solidpaint.pl, hereinafter referred to as the "Website". It will also allow you to find out on what terms and for what purpose we can process your personal data, as well as what rights you are entitled to in this connection.

General information

By implementing legal obligations resulting from the "GDPR", i.e. of the general regulation on the protection of personal data 2016/679, we would like to inform you that the administrator of your personal data is Mr. Wojciech Borowski, who runs a sole proprietorship under the name AL-KOR Wojciech Borowski with headquarters in Gdynia (81 - 538) at ul. Olimpijska 2, NIP: 741-118-65-82, REGON: 280465940 (hereinafter: "AL-KOR").

Providing your data in connection with the use of the Website or the submission and implementation of orders by AL-KOR is voluntary, however, providing some data may be necessary to conclude and perform the contract with AL-KOR and legal obligations (e.g. providing data for an invoice), as well as for the other purposes described below.

Rules for using the Website

All content on the Website pages, including trademarks and trade names, photos and descriptions of products and other materials, are protected by law and any use may be made only with the prior written consent of AL-KOR or another authorized entity.

Using the Website and its functionalities, including the contact form, requires Internet access and an active and correctly configured e-mail account (e-mail), as well as a constantly updated web browser, e.g. Internet Explorer, Chrome, Firefox, Opera, Safari .

It is forbidden to use the Website in a way that interferes with the use of it by AL-KOR and its users, as well as providing illegal content via the Website, including content that violates personal rights and other rights of third parties, acts in a manner that violates the law or in in order to circumvent the law, as well as in conflict with the principles of social coexistence or morality.

AL-KOR may enable ordering free technical and industry information and information relating to the current AL-KOR offer through the Website, which will take the form of a newsletter. The newsletter will be sent only at your request - you will be able to withdraw your consent to receive it at any time.

AL-KOR uses technical measures on the Website to protect electronic messages and digital content sent via the Website and in connection with its activities, including SSL encryption, access passwords or anti-virus programs and against unwanted software. Nevertheless, we would like to point out that the use of the Internet and services provided electronically is always associated with the risk of unauthorized access to the transmitted data, therefore we recommend that you also use appropriate safeguards, e.g. anti-virus programs.

The purpose of processing and the legal basis for processing your personal data by AL-KOR

Depending on the situation, AL-KOR may process your personal data for the purposes and to the extent necessary to contact, conclude a contract and cooperate with AL-KOR, in particular in the following circumstances:

1. Presentation of the offer, conclusion or performance of a contract with AL-KOR - the processing of your personal data as Partners, Customers, Contractors and persons indicated by them (including their employees and associates), as well as persons interested in the AL-KOR offer takes place in order to present the offer or conclusion or performance of a contract or on the basis of the legitimate interest of AL-KOR, which is direct marketing of AL-KOR products or services (e.g. fire-resistant paints, industrial paints, paints for concrete, technical design services of a painting set, technical consulting services, after-sales service ), enabling communication with you and preparing for the conclusion and performance of this contract. In addition, we may process personal data in order to fulfill legal obligations, e.g. to issue an invoice. Providing personal data is always voluntary, but it may be necessary for the conclusion and proper performance of the contract. In the cases described above, AL-KOR will process your data for the period of validity agreement concluded with you and the period necessary to enable the parties to exercise claims arising from such agreement - not shorter, however, than the period resulting from legal provisions (limitation period), the duration of proceedings for which it is necessary to process personal data by AL-KOR or so as long as it is necessary to pursue the legitimate interest of AL-KOR or a third party.
   
   
2. Persons contacting AL-KOR - the purpose of processing personal data is communication with persons contacting AL-KOR. The legal basis for the processing of personal data is the legitimate interest of AL-KOR consisting in enabling communication, possibly establishing a relationship with the contact person, providing the necessary information. Depending on the content of the correspondence, the processed data may include in particular: name, surname, e-mail address, telephone number, correspondence address and other information provided by the person contacting AL-KOR. Providing personal data is voluntary, however, in the event of failure to provide personal data, the communication process may be difficult or impossible to implement. In the case of inquiries, product and information inquiries as well as regarding the terms of cooperation, we may store your data for the period of running a business by AL-KOR or until the contact person requests that their data and content of inquiries be erased from the database or as long as necessary to pursue the legitimate interest of AL-KOR or a third party.
   
   
3. Candidates for work - the primary purpose of personal data processing is to carry out the recruitment process. Processing of personal data of job applicants, such as: name (s) and surname, parents' names, date of birth, place of residence (correspondence address), education, course of previous employment - takes place on the basis of the provisions of law (Labor Code) or to the extent exceeding such data - based on the consent of the candidate for work expressed by including additional data in the recruitment documents. The provision of personal data is voluntary, however, in the event of failure to provide personal data, it will not be possible to participate in the recruitment process. As regards the data collected during the interview and the results of the qualification tests - AL-KOR will process them to check the skills and abilities of the Candidate in order to assess whether the Candidate is the right person for the position for which AL-KOR will recruit. The period of storage of personal data in this case is 3 months. If the candidate agrees to the processing of personal data during further recruitment, this period will be a maximum of 24 months from the end of the calendar year in which the consent was granted.
   
   
4. Other, legally justified purposes of AL-KOR. Based on the legitimate interest, AL-KOR may use functionalities on the Website for:

• conducting research and analysis of the activity of you and other users of the Website in order to improve the efficiency of operation, assess the expectations and needs of users and improve the Website, introduce new products and services, as well as for statistical purposes,
  
  
• providing you with commercial information and marketing content as well as technical information regarding products or services offered by us or our partners - to the extent permitted by law, including with your consent, using various available means of communication,
  
  
• organization or co-organization of promotional campaigns or loyalty programs for Website users,
  
  
• communication with you for purposes other than those directly related to the possibility of concluding and implementing the contract,
  
  
• ensuring the safety of using www.al-kor.eu, to counteract fraud and abuse and to maintain the correctness and continuity of the Website, including by creating backups,
  
  
• establishing, investigating or defending claims of AL-KOR Wojciech Borowski and demonstrating compliance by AL-KOR Wojciech Borowski with obligations under the law.

When processing your data for the purposes described above, AL-KOR does not profile you based on the personal data it has, i.e. AL-KOR does not use systems leading to automated decision-making in relation to you. AL-KOR does not intend to transfer your data to third countries - outside the European Economic Area, unless it is justified by the circumstances of the contract, about which AL-KOR will inform you in advance.

AL-KOR applies technical and organizational measures to ensure the protection of personal data being processed, appropriate to the threats and categories of your data protected, in particular, it secures the data technically and organisationally against unauthorized disclosure, removal by an unauthorized person or unlawfully and against change, loss, damage or destruction, using, inter alia, SSL certificates on the Website.

Data recipients

As a rule, only authorized employees or associates of AL-KOR and authorized persons servicing the Website who have been granted appropriate powers of attorney have direct access to personal data processed by AL-KOR.

Users' personal data may be made available to entities authorized to receive them under applicable law, in particular to the competent judicial authorities.

In accordance with the applicable law, we would like to inform you that your data may be transferred by AL-KOR - to the extent necessary - to entities processing them on behalf of AL-KOR, i.e. in particular carriers, postal operators, entities involved in handling and maintaining cooperating with AL-KOR. our IT systems and websites as well as accounting offices providing accounting services for AL-KOR. Such entities process data on the basis of the contract concluded with AL-KOR and only to the extent necessary to provide services provided by the above-mentioned entities in accordance with our instructions.

At the same time, we would like to inform you that your personal data will not be transferred to third countries or to international organizations within the meaning of the GDPR. If, however, it turns out to be necessary or justified, the transfer of your data to a third country will take place in accordance with the applicable legal regulations.

Rights related to the processing of your personal data

According to the GDPR, you have a number of rights resulting from the processing of your personal data, including:

• the right to access personal data, including the right to obtain a copy of this data,
  
  
• the right to request rectification (correction) of personal data - when you notice that the data is incorrect or incomplete,
  
  
• the right to request the deletion of personal data (the so-called "right to be forgotten") - provided, however, that the data is no longer necessary for the purposes for which it was collected or otherwise processed or you object to data processing or withdraw your consent on which the processing is based and there is no other legal basis for the processing or the data is processed unlawfully or must be removed in order to fulfill the obligation resulting from legal provisions,
  
  
• the right to request the restriction of the processing of personal data - if you indicate that your data is incorrect, the processing of data is unlawful, but you do not want to delete it, when your data is not needed by us, but you will need it to establish, defend or pursuing claims, or when you object to the processing of data - until it is determined whether the legitimate grounds for data processing by us override the grounds of your objection,
  
  
• the right to transfer personal data - if the processing takes place automatically on the basis of a contract concluded with you or on the basis of your consent.

You also have the right to object to the processing of personal data, including profiling - if we process your data on the basis of a legitimate interest and the objection is justified by your particular situation. In cases where the processing of personal data would take place on the basis of your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of the processing which was carried out on the basis of such consent before its withdrawal.

All requests regarding the exercise of the above rights can be submitted in writing or by e-mail to the addresses AL-KOR indicated above. We will do our best to respond to your requests promptly and no later than one month after receiving them, unless they prove to be numerous or complex. All requests are free of charge, but if they prove to be manifestly unfounded or excessive, we may charge a reasonable fee, taking into account the cost of communicating or performing the requested action, or refuse to act on the request.

If you believe that AL-KOR violates the law by processing your personal data, please contact us - in accordance with the data provided above. Regardless of this, you have the right to lodge a complaint with the supervisory authority, which in Poland is the President of the Personal Data Protection Office.

Cookies

AL-KOR may use cookies (small text files downloaded to the user's computer that can be used to store information about the user and his preferences) and other

similar technologies, in order to fully use the functionality of the Website and to display personalized advertisements and to monitor traffic on the Website and visit statistics. The Website may also contain the so-called social and marketing plugins that may also use cookies.

You can change the settings of the web browser you use at any time, specifying the conditions for storing cookies, by changing the web browser settings yourself, and also removing them yourself, which may affect the availability of the Website's functions.

Disclaimer of Liability

This Privacy Policy does not cover any information regarding services or goods offered by entities other than AL-KOR, and which have been posted on the Website's pages commercially, as a guest, on a reciprocal basis or even not intended to achieve a direct or indirect commercial effect.

AL-KOR is not responsible for the actions or omissions of users, as a result of which AL-KOR processes the personal data provided by them in the manner specified in this Privacy Policy.

AL-KOR reserves the right to change, withdraw or modify the functions or properties of the Website's websites, as well as to cease operations, transfer the rights to the website and perform any legal actions permitted by applicable law. All activities performed by AL-KOR may not infringe the rights of the user.

This Policy is valid from 01/01/2019.

AL-KOR reserves the right to make changes to the Privacy Policy at any time, and both the current and the previous versions of the Policy will be available on the Website's pages.
